I have the honour to acknowledge the receipt
of Lord Passfield's despatch No.189 dated 3rd July, 1931, on the subject of an application by Mr. J. H. Ruttonjee to purchase an area of foreshore and seabed in the New Territories, and the conditions governing the issue of Crown leases of Marine Lots in Hong Kong, and in reply to the points raised in the second paragraph of the despatch
under reference to state that:-
(1) In the event of resumption by the Government at
the end of the first period of 75 years of a renewable lease the basis on which compensation would be paid is the value of the premises to the lessee for the period for which renewal is
denied.
(2) In all Crown leases for renewable terms there is
a clear proviso that the renewed term shall be at such rent as shall be fairly and impartially fixed by the Director of Public Works as a fair and reasonable rental value of the ground at the date of the renewal.
